When a Divorce is uncontested, it means both parties have decided that they should be divorced and can agree on the terms of the divorce, can divide property and money without court intervention and can determine a visitation schedule and a parenting plan without a judge resolving those issues for them.  A good lawyer will assist the client to come to an agreement without the need for motions or unnecessary hearings before the Judge.

An Uncontested Divorce can also mean that the responding spouse does not answer or challenge the petitioning spouse’s allegations.  So sometimes an uncontested divorce can occur because a spouse has defaulted or has filed an Answer and Waiver to the Petition for Dissolution of Marriage.
